Alimony was meant to support women post-divorce, but recent cases show it's sparking violence instead. Alimony laws were created to protect women from financial hardship after a divorce, ensuring they receive support to rebuild their lives. However, a disturbing trend is emerging—cases where alimony disputes are turning into crimes. The latest tragic incident comes from Modinagar, where a man allegedly murdered his ex-wife to avoid paying maintenance.

The Haridwar Murder

On January 21, 40-year-old Madhu Sharma went missing. Her sister, Manju Sharma, first reported her disappearance to the police on January 23. Days later, on January 31, she returned with a more alarming complaint—alleging that Madhu had been kidnapped and murdered by her ex-husband, Virendra Sharma.

The two had married in 2002 but separated just two years later as Madhu started living with her parents. Virendra filed for divorce, which was granted in 2014. However, in September 2024, a court ordered him to pay Madhu a monthly maintenance of ₹6,000 along with a lump sum of ₹5 lakh. Rather than complying, police say Virendra plotted to eliminate his ex-wife.

He allegedly convinced her to go on a trip to Chandi Mandir in Haridwar. On their way back, he reportedly strangled her with her dupatta in a secluded area and hid her body in the jungle. The police later recovered her remains and the Swift car used in the crime. He was arrested on February 1 from Modinagar’s Saunda Road, where he allegedly confessed.

The Bengaluru Alimony Case: A Tragic Outcome

Another case that gained national attention was that of Atul Subhash in Bengaluru. Unlike other violent alimony disputes, this case ended with tragedy. Atul, unable to cope with the financial burden imposed by alimony payments, died by suicide. His death highlighted the immense psychological and financial pressure that some individuals face due to court-mandated maintenance obligations. His case sparked debates about the fairness and implementation of alimony laws, with many arguing that the system should be designed to prevent financial burden for either party involved.

Alimony: A System in Need of Reform

Alimony was originally designed to prevent financial exploitation of women. However, recent incidents show it is now leading to violent extremes and personal tragedies. While many women genuinely need and deserve support, there are increasing cases where bitterness over financial settlements leads to tragic outcomes.

It’s time for lawmakers to rethink alimony laws. Can there be a fairer system? Should there be stricter enforcement mechanisms that don’t create resentment? More importantly, how do we prevent such horrifying cases from happening again? Potential reforms could include:

  • Encouraging Financial Independence for Women: Rather than long-term alimony, more focus should be placed on skill-building and employment opportunities for women post-divorce.

  • Income-Based Adjustments: Ensuring that alimony payments are fair and do not financially cripple the paying spouse.

  • Time-Limited Support: Instead of indefinite payments, setting a reasonable timeframe for financial support based on factors like employability and financial stability.

  • Mutual Financial Responsibility: Encouraging settlements where both parties contribute to post-divorce financial stability rather than a one-sided dependency.

  • Mental Health Considerations: Providing counseling and financial planning resources for those affected by divorce settlements to prevent extreme outcomes.

While child maintenance is essential and should remain protected, spousal alimony needs reform to prevent abuse and financial distress. Women should be empowered to achieve independence rather than remain dependent on payments that often lead to legal battles, emotional trauma, and, in extreme cases, crime. As society evolves, laws must also adapt. Otherwise, what was once meant to protect might continue to put lives in danger.
