As Uttarakhand becomes the first state of independent India to implement the Uniform Civil Code (UCC), celebrations have erupted across the Himalayan state. While questions and doubts linger among citizens and politicians, Chief Minister Pushkar Singh Dhami successfully secured approvals for the implementation of the Act and initiated training programs for officials to ensure its smooth enforcement.

Speaking on this historic occasion, Dhami told the media, “The UCC's implementation represents a significant milestone, making our state the first in the country to adopt this progressive legislation since independence.”

While Goa has long operated under a UCC, its adoption dates back to the pre-independence era. Uttarakhand, however, is the first state to embrace the code post-independence. With this decision, the government fulfills one of its key promises made during the 2022 election campaign.

The Uniform Civil Code standardizes personal laws across all religions, addressing key areas like marriage, inheritance, adoption, and more. Its primary goal is to simplify legal processes and ensure fairness for everyone. Key features include:

  1. Equality in Marriage Laws: The UCC provides uniform regulations for marriage, divorce, and maintenance, ensuring equal treatment across religions.

  2. Inheritance and Property Rights: Equal property rights for men and women are mandated, promoting gender equality in inheritance matters.

  3. Compulsory Marriage Registration: Legal obligations to register all marriages aim to enhance transparency and minimize disputes.

  4. Streamlined Adoption Rules: A single, uniform process for adoption is established to ensure the child’s welfare and fairness across communities.

  5. Regulation of Live-in Relationships: Clear legal recognition and defined rights and obligations for live-in partners are introduced.

These provisions aim to simplify personal laws, making contentious issues like divorce, maintenance, live-in relationships, and adoption more straightforward for residents and the judiciary alike.

The UCC in Uttarakhand applies to all permanent residents, irrespective of their religion, caste, or gender. Individuals from other states, such as Uttar Pradesh, who acquire permanent residency or domicile in Uttarakhand will also be governed by the UCC. However, temporary residents—such as visitors or short-term workers—will generally remain outside its purview unless their legal matters fall under the state’s jurisdiction. This framework ensures uniformity in personal laws, fostering inclusivity and equality among all who reside in the state.

The decision to implement the UCC has drawn criticism from some political leaders, who argue that it may be overambitious and lead to societal divisions. However, to them, a simple suggestion would suffice: check out their pocket constitution first. Article 44 of the Indian Constitution clearly advocates for a uniform civil code across the country. Moreover, the Supreme Court has repeatedly highlighted the importance of uniformity in personal laws, emphasizing India's need for a common code to promote justice and equality.

With Uttarakhand taking the lead, this landmark decision sets an example for other states to consider the benefits of adopting progressive legislation.
